Welcome to the “The Internet 800 Directory Newsletter”. This week we have an article sent to us by Judith Oppenheimer. Judith publishes ICB Toll Free News (http://www.icbtollfree.com/) and is a well-known pro-user advocate, working to protect and promote the interests of business toll free number 'owners' at the FCC and 800 industry standards and practices forums. ICB Toll Free News recently dropped all registration requirements; the 5800+ article archive is keyword searchable and freely available.

Ms. Oppenheimer also publishes WhoSells800.com; her advocacy stance is reflected in the quality of service enjoyed by WhoSells800 customers.

-- Is it legal to buy and sell toll free numbers?

Chuck, it’s been some time since we contributed to your newsletter. Two questions have been dominating Ask the Expert on WhoSells800.com, so perhaps its time to address them publicly.

800 Numbers: Can I buy and sell ‘em?

There seems to be some uncertainty swirling around whether it’s legal to buy and sell toll free numbers: its not! See ICB Toll Free News (http://www.icbtollfree.com/) article FCC Proscribes 800 Transfers Between Subscribers (http://www.icbtollfree.com/article_free.cfm?articleId=4894) – according to the FCC, it’s not even legal to transfer them!

As a matter of policy we don’t agree and have petitioned the FCC to change the rules. (See http://www.1800afta.org/ for more information).

As a practical matter, if a toll free number broker (they’re all over the net) offers to sell or help you buy a number and doesn’t provide complete and full disclosure first that it’s not legal and what the ramifications are, head for the hills because:

-- entrapment or enforcement (fines and worse) could result.

-- the number you get may not be yours for long.

ICB Consulting (http://www.judithoppenheimer.com/) does lost-and-stolen-number recovery, among other things. A number returned to its rightful ‘owner’ does not replace your funds already cleared by the legal-facts and candor-challenged broker. (Of course, notified in advance of the activity’s illegal nature it’s a moot point because you would have nothing further to do with a number transaction. Right?)

I reserved an 855 vanity number. When are they coming out?

The fifth toll free code was supposed to be released simultaneous with the release of 866; at this point, if and when it will be released is anybody’s guess. But if you’ve got an 855 number reserved, you don’t anymore: as the ICB title says, 855 Number Reservations [are] To Be Quietly Released (http://www.icbtollfree.com/article_free.cfm?articleId=5782).

In October 2002 the FCC gave the industry an informal nod to release the 855 number reservations. There was no mention of contacting 855 reservation holders.
